Understanding Mobile Recharge Withholding Tax in Pakistan: Explained and Refund Process

The withholding tax on cell recharge is required due to the undocumented economy, a tiny tax base, and low revenue collection, according to the Ministry of Finance, which has defended the collection of this tax on mobile users.

However, the ministry has highlighted that anybody can file a return to obtain a refund of taxes that were withheld, including those whose income is below the taxable threshold.

According to official records, withholding tax is imposed on mobile users whose income is below the minimum level for submitting a tax return to claim such a tax adjustment or refund, such as students, daily wagerers, and Ehsas Program participants.

Each recharge paid by the customer is subject to a 15% withholding tax by telecommunications companies. On a recharge of Rs. 100, a tax of Rs. 13.04 is deducted as withholding tax.

FED @19.5 percent is a levy on communications services in the Islamabad Capital Territory (ICT) (Rs. 16.52 on the value of Rs. 86.96). The general sales tax (GST) on communications services is imposed in locations other than ICT in line with provincial law.

Tax at source collection is also required for certain expenditures or transactions with significant informational or mapping value. Additionally scalable is the withholding tax on smartphone recharges. Anyone can obtain a refund of taxes already paid by filing a return, even if their income is below the taxation level.

The Ministry further noted that the taxation of mobile phone expenses was affirmed by the Pakistani Supreme Court after it was given a thorough legal review.

For an impoverished country like Pakistan to pay its financial responsibilities, taxes must be withheld. You can claim the tax that was deducted by submitting a simple return. It is important to remember that the Supreme Court upheld the validity of the withholding tax on mobile recharge and declared it to be legitimate.

The Income Tax Ordinance of 2001 has no provision for granting certificates to individuals whose income is below the minimum required for submitting a tax return. Only individuals with income that is exempt from taxation under one or more sections of the Income Tax Ordinance, 2001, are eligible for an exemption certificate.

The Ministry further clarified that this tax is not the lowest nor the last one imposed by the programme. You can recoup the refundable tax that was subtracted by filing a basic return. Anyone can file a return and get their tax deductions repaid, including those with earnings below the taxable threshold.
