The Ministry of Information Technology and Telecommunication has initiated the process of withdrawing the Pakistan Telecommunication Re-organisation Amendment Bill 2026 from the Senate, announcing its intention to introduce a fresh bill that retains the essence of the proposed legislation while allowing the parliamentary process to proceed more swiftly. The decision was driven by the approaching expiry of the bill’s stipulated 90-day period, after which it would automatically proceed to a joint sitting of parliament, a forum the ministry noted may not convene in the near future and which would introduce further delays into what it described as time-sensitive legislative reform for Pakistan’s telecommunications sector.
The bill had cleared the National Assembly on June 11 by a majority vote before being referred to the Senate Standing Committee on Information Technology and Telecommunication on June 15, where its consideration was deferred amid significant political opposition. Pakistan Tehreek-e-Insaf raised objections to the legislation, while Pakistan Peoples Party also expressed reservations, with PPP Senator Sherry Rehman stating that her party would not support legislation concerning the information technology sector, PTA, or right of way unless it was thoroughly scrutinised and amended through the relevant standing committee process. The primary flashpoint in the opposition was a set of provisions relating to the right of way for telecom infrastructure on public and private property, which drew criticism from multiple quarters over concerns that the bill could enable intrusive or involuntary access to private land for the purposes of installing telecommunications equipment.
In response to those concerns, Prime Minister Shehbaz Sharif constituted a dedicated committee to review the proposed legislation and specifically examine the right-of-way framework under Sections 2(qb), 2(ma), 27A, and 27B of the amendment bill. The Ministry of Information Technology and Telecommunication subsequently issued clarifications rejecting the characterisation of the bill as enabling forcible land acquisition, stating that property owners would retain the right to raise objections, negotiate terms, and seek appropriate compensation before any infrastructure work could be carried out on privately owned land.
Law Minister Azam Nazeer Tarar and IT Minister Shaza Fatima Khawaja both publicly denied allegations that the bill would allow telecom companies to occupy private property without consent. Shaza had also contextualised the urgency behind the legislation, noting that the existing legal framework governing Pakistan’s telecommunications sector was drafted during the second-generation mobile era and was fundamentally insufficient to meet the infrastructure and right-of-way requirements of fifth-generation networks and newer technologies. The fresh bill the ministry now plans to introduce is expected to address the political and legal concerns that derailed the first attempt while preserving the core objectives of the reform.
